H-1B Visa: Specialty Occupations

H-1B Visa is a non-immigrant visa which allows U.S. employers to temporarily employ foreign
professionals in specialty occupations for three years, extendable to six years

To qualify for H1B Visa, the foreign professional must hold a bachelor’s or higher degree from an accredited college or university in the specialty occupation. If the foreign professional holds a foreign degree, then that degree must be determined to be the educational equivalent of a U.S. bachelor’s degree.

The H1B visa is a non-immigrant work permit visa. This visa is being given to foreign workers is being employed by US employer to come and work in US under specialty occupation. The visa is valid for maximum of 6 years. This visa cannot be applied by any person who wishes to work in US but has to be petitioned by the US employer.

An H1B visa is generally good for three years.  The visa may be extended for an additional three years.  To obtain an extension, the employer must file a new Form I-129 and submit additional filing fees.  The cap-subject employer need not worry about the H1B cap for a renewal because the employee has been already been counted against the cap and the cap does not come into play on an H1B renewal.
